1. Parties and acceptance

This website (the “Website”) is operated by TEX GROUP TURİZM LİMİTED ŞİRKETİ (“TEX Group”). Our company details are on the Legal Notice page. Anyone who visits or uses the Website (the “User”) is deemed to accept these terms. If you do not accept them, please do not use the Website.

2. Purpose of the Website

The Website presents TEX Group, its business lines, the TEX Professionals specialist network and the way we work.

• The content is general information; it is not an offer, a binding commitment or a guarantee.

• The content does not replace legal, financial, tax, investment or technical advice. We recommend obtaining professional advice specific to your situation before making decisions.

3. Services and contracts

The scope, duration, fees and other terms of our services are set only in a written agreement between the parties. Service descriptions on the Website are examples and may vary by project. Contacting us through the contact form does not create a contract and does not oblige either party to buy or provide any service.

4. Case studies, references and figures

• The case studies in the “Work” section also include the professional experience that TEX Professionals specialists gained at other organisations in the past. Unless a case study clearly states that it is a TEX Group project, it is not presented as a project carried out directly by TEX Group.

• Results such as occupancy, revenue or efficiency shared in case studies depend on the conditions of the project concerned and are not guaranteed for any other property or project. Past results are not an indication of future results.

• Property and client names are not disclosed for confidentiality reasons.

5. Information for investors

Content on the Website aimed at investors is prepared only to present TEX Group’s services. It is not investment advice, an investment recommendation or an offer to sell capital market instruments under the Turkish Capital Markets Law No. 6362. Investment decisions should be based on the investor’s own assessment, the opinion of independent advisers and the agreements to be made between the parties. TEX Group does not promise any return or increase in value.

6. Job postings

Job postings on the Website are for information and are not job offers. Postings may be changed or removed without notice. How personal data is processed in applications is explained in our Candidate Privacy Notice.

7. Intellectual property

The texts, images, photos, graphics, design, software, logos and brand names beginning with TEX on the Website belong to TEX Group or are used by TEX Group under licence, and are protected under the Turkish Law on Intellectual and Artistic Works No. 5846 and the Industrial Property Law No. 6769. They may not be copied, reproduced, distributed, modified or used commercially without TEX Group’s written permission. Short quotations for personal, non-commercial purposes are allowed with attribution and without modification.

8. Rules of use

When using the Website, you agree not to:

• Act in breach of applicable law, public morality or the rights of third parties,

• Attempt to disrupt the Website, overload it or compromise its security,

• Attempt unauthorised access to the Website or our systems, or send malicious software,

• Collect data without permission by automated means (bots, scrapers, etc.),

• Send misleading, unlawful or offensive information, or third-party information without authorisation, through the contact form,

• Use the name, brands or logos of TEX Group or its business lines without permission.

9. The contact form and the information you send

You are responsible for the accuracy of the information you send through the form and, if you share information about someone else, for being authorised to do so. Please do not send confidential business information, special categories of personal data or sensitive information such as passwords through the form. The personal data you send is processed as described in our Privacy Policy and KVKK Information Notice.

10. Third-party links and services

The Website may contain links to third-party websites or third-party services. The third parties concerned are responsible for the content, security and privacy practices of those websites and services. A link does not mean that TEX Group endorses the content.

11. Availability and changes to the Website

TEX Group may change the content, design and operation of the Website at any time without notice, and may take the Website offline temporarily or permanently. Access may occasionally be interrupted for maintenance, updates or technical faults.

12. Limitation of liability

TEX Group takes care to keep the information on the Website accurate and up to date, but does not guarantee that it is complete, that the Website will be available without interruption, or that it will work without errors or malicious software. Except for intent, gross negligence and other cases where liability cannot be limited by law, TEX Group is not liable for any direct or indirect damage arising from the use of, or inability to use, the Website.

13. User responsibility

To the extent permitted by law, you are responsible for any damage suffered by TEX Group or third parties because you breach these terms.

14. Personal data and cookies

How personal data is processed is explained in our Privacy Policy, KVKK Information Notice and Cookie Policy.

15. Force majeure

TEX Group is not liable if the Website cannot be used or obligations cannot be fulfilled because of events beyond its control, such as natural disasters, epidemics, war, terrorism, strikes, cyber attacks, infrastructure or power outages, or decisions of public authorities.

16. Evidence

In disputes arising from these terms, TEX Group’s electronic and system records constitute evidence under Article 193 of the Turkish Code of Civil Procedure No. 6100. This does not remove consumers’ right to submit counter-evidence or their rights under consumer legislation.

17. Severability and waiver

If any provision of these terms is held invalid, the other provisions remain valid. TEX Group’s failure to exercise a right does not constitute a waiver of that right.

18. Changes

TEX Group may update these terms when necessary. Changes apply to use of the Website after the date they are published on this page.

19. Governing law and jurisdiction

These terms are governed by the laws of the Republic of Türkiye. For disputes with users who are merchants or public legal entities, the courts and enforcement offices of Antalya have jurisdiction; for other users, the statutory rules of jurisdiction apply. The rights of users acting as consumers under the Turkish Consumer Protection Law No. 6502, including the right to apply to consumer arbitration committees and consumer courts, are reserved.
